Terms and Conditions

These terms explain what PropLead supplies, how purchased leads may be used, and when account credit is available. They are intended for business purchases of property leads.

Who we are

PropLead is owned and operated by Enzo Sanchez, trading as PropLead (“PropLead”, “we”, “us” or “our”).

These terms govern use of our website and the purchase and use of property leads. “You” means the business customer placing an order and, where applicable, the organisation that person is authorised to represent.

Business customers and acceptance

Our paid lead service is intended for deal sourcers, property investors and other customers purchasing wholly or mainly for their trade, business, craft or profession. You must be at least 18 and have authority to enter into the contract.

By accepting these terms at checkout and placing an order, you agree to be bound by them. You must give accurate account and billing information and keep your login details secure. Tell us promptly if you suspect unauthorised access.

A declaration that you are a business customer does not remove consumer rights where, as a matter of law, you are acting as a consumer. Nothing in these terms excludes rights or remedies that cannot lawfully be excluded.

What you are buying

PropLead supplies access to property enquiry information and contact details to help customers explore off-market opportunities. Depending on the listing, these may include below-market-value opportunities, rent-to-rent, serviced accommodation, HMO and other property enquiries.

You are buying the lead described at checkout, not a property, a tenancy, a guaranteed appointment, an instruction to act, or a completed transaction. Our fee pays for access to that information and is not conditional on your securing a deal.

“Off-market” describes the opportunity as presented to us when listed. It does not guarantee that the property has never been advertised, that no agent is involved, or that the contact is not speaking to other parties. A description such as “BMV” is not an independent valuation or a guaranteed discount.

Unless expressly agreed separately in writing, our service does not include negotiating transactions, acting as your representative, arranging finance, providing legal or investment advice, or checking a property's suitability for your plans.

Telephone verification and lead information

Every telephone number supplied as a paid lead is verified using a one-time password (“OTP”) before the lead is made available for purchase. OTP verification means a code sent to that number was successfully entered during verification.

OTP verification confirms access to the number at that time. It does not establish the person's identity, property ownership, authority to let or sell, financial position, willingness to proceed, or ability to receive voice calls at all later times.

Property and enquiry information may be supplied by the person submitting the lead. We will use reasonable care and skill in providing our service, but information and circumstances can change. Unless a specific check is expressly stated in the listing, do not assume we have independently verified title, valuation, rental income, planning permission, licensing, lender consent or projected returns.

You must carry out your own due diligence and obtain appropriate professional advice before spending money, making commitments or entering into a property transaction. These requirements do not excuse us from supplying what we expressly agreed to supply.

Orders, payment and delivery

The price and any applicable taxes will be shown before you pay. Payment must be received before paid lead details are released. A contract for a lead is formed when we confirm acceptance of your order electronically. An automated payment receipt alone does not amount to acceptance unless it expressly confirms the order.

We deliver by making the purchased details accessible through your account or the delivery method specified at checkout. You should check the listing and price carefully before ordering and contact the lead promptly after delivery.

If we cannot supply a purchased lead, we will refund the amount paid for it. Duplicate payments and incorrect charges will be corrected. These are billing or non-delivery corrections, separate from the lead-quality credit policy below.

Any free-lead offer is subject to the eligibility conditions shown with that offer. You must not create multiple accounts or use false details to obtain repeated promotional benefits.

Exclusive access and permitted use

Once you purchase a lead, PropLead will not resell that same lead to another customer. This exclusivity concerns our distribution of the lead. It does not prevent the property contact from advertising elsewhere, using another provider or dealing with other people.

You may use the lead only for the relevant property enquiry and your legitimate business assessment of that opportunity. You may share information with staff, professional advisers or a genuine investor client only where necessary for that purpose, legally permitted and subject to appropriate confidentiality and data protection safeguards.

You must not resell the contact details as a standalone lead, publish them, distribute them in bulk, upload them to a shared lead marketplace, or use them for unrelated marketing. Purchasing a lead does not give you ownership of the person's personal data or override their privacy rights.

Strict account credit policy for lead quality

Subject to rights and remedies that cannot lawfully be excluded, our voluntary lead-quality credit policy applies only where the telephone number supplied is disconnected, out of service or otherwise technically non-functioning for incoming calls when the lead is supplied.

A number is not treated as non-functioning merely because the person does not answer, a call goes to voicemail, the phone is switched off, the line is busy, reception is poor, there is a temporary network problem, or your number has been blocked.

No credit is available under this voluntary policy because the contact does not reply to calls, texts, emails or messages; declines an offer; changes their mind; withdraws the property; has already reached an agreement elsewhere; uses an agent; or does not agree to your proposed price, rent, fees or terms.

The policy also does not cover a change of mind after purchase, accidental selection of a lead, a lead you already know through another source, failure to arrange a viewing or secure a deal, disappointing returns, or an opportunity that does not meet your business preferences.

A working number answered by an unrelated person is not a disconnected-number claim. However, a materially incorrect contact, material misdescription, non-delivery or other breach by PropLead will be considered separately under the contract and applicable law. This policy does not allow us to charge for something we have failed to supply as agreed.

An OTP verification record is evidence of verification at that time, not conclusive proof that a later credit claim is invalid.

How to report an issue and request credit

Report a suspected non-functioning number to enzosanchez1785@gmail.com within one business day after the lead is delivered. A business day means Monday to Friday, excluding public holidays in England and Wales. The deadline is the same local time on the next business day, using Europe/London time. For example, a lead delivered at 2 pm on Friday must be reported by 2 pm on Monday, unless Monday is a public holiday. This deadline applies to our voluntary credit policy only and does not shorten any statutory limitation period or remove other legal remedies.

Include your name, account email, order or lead reference, the telephone number supplied, the dates and times of your attempts, and the exact network message or fault encountered. Provide any reasonably available call log or screenshot. Do not send unnecessary third-party personal data or make unlawful recordings.

Check that you dialled the number correctly, including the country code where appropriate. We may test the number, review our verification records and request reasonable additional information to distinguish a disconnected number from a temporary fault or unanswered call. We will not require you to contact someone who has asked you to stop.

We aim to give a written decision within ten working days after receiving enough information to assess the claim. If more time is reasonably needed, we will explain why. We will assess the evidence fairly and give reasons if we reject the claim.

If the claim is approved under this voluntary policy, we will top up your PropLead account with credit equal to the amount paid for the affected lead, including any tax charged on it, within five business days of approval. This credit can be used against future lead purchases and has no expiry date. It is not transferable or redeemable for cash. No cash refund is offered under this voluntary policy. Where the law requires a cash refund or another remedy, that entitlement remains unaffected.

A credit for one lead does not entitle you to credits for unrelated leads. You must stop using credited lead details, except to the extent that retention is legally required or necessary to resolve a dispute. You must not submit fabricated evidence or knowingly false claims.

Privacy and contacting leads

Both PropLead and customers must comply with applicable data protection and electronic marketing law, including the UK GDPR, the Data Protection Act 2018 and PECR, as amended. PropLead remains responsible for the lawfulness and transparency of its own collection and disclosure of lead information.

When you determine how and why to use personal data supplied to you, you are responsible for your own processing as an independent controller. Establish an appropriate lawful basis, provide any required privacy information, protect the data, retain it only as long as necessary and respond appropriately to individuals' rights requests.

OTP verification is not consent to marketing. Purchasing a lead does not itself authorise every form of contact. Before contacting someone, check the enquiry's scope, applicable consent requirements, relevant Telephone Preference Service or Corporate Telephone Preference Service restrictions and your own suppression records.

Identify yourself accurately, explain the purpose of contact and respect objections or requests to stop. Do not harass contacts, misrepresent your relationship with PropLead or add people to unrelated marketing lists. If a person disputes submitting the enquiry, stop unnecessary contact and notify us so we can investigate.

Our separate Privacy Notice explains how PropLead handles personal data. These terms do not replace that notice or the permissions and disclosures needed when collecting leads.

Website use and account restrictions

You must not scrape or harvest our database, bypass payment or access controls, share account credentials outside authorised users, introduce malicious code, impersonate another person or interfere with the website. Website content and database rights remain with PropLead or the relevant rights holders.

We may restrict access where reasonably necessary to investigate fraud, protect personal data, address unlawful activity or respond to a material breach. Where appropriate, we will explain the reason and give an opportunity to remedy the breach. We may terminate an account for a serious or repeated breach.

Suspension or termination does not automatically forfeit refunds or remedies otherwise due. We may retain relevant records where necessary for legal obligations or dispute resolution. We do not guarantee uninterrupted website access, but will use reasonable care in maintaining the service.

Responsibility and liability

You remain responsible for your negotiations, representations, professional obligations and property transactions. We do not guarantee that a lead will result in a response, appointment, agreement, profit or investment return.

To the extent permitted by law and subject to any applicable reasonableness requirement, we are not liable for indirect or consequential business losses arising from use of the service. This does not exclude repayment or compensation that the law requires us to provide.

Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any liability that cannot lawfully be excluded or limited. Nor do these terms remove our obligation to exercise reasonable care and skill or honour express commitments about the service.

We are not responsible for delays caused by events outside our reasonable control, but will take reasonable steps to reduce their effect. This does not allow us to retain payment indefinitely for a lead we cannot deliver.

Complaints, changes and governing law

Send complaints to enzosanchez1785@gmail.com with the relevant order details and the outcome you are seeking. We encourage you to contact us first so we can investigate. Nothing in these terms prevents a genuine payment dispute, lawful chargeback or court claim.

We may update these terms for future orders by publishing a revised version. The version accepted when you place an order continues to govern that order unless a change is required by law or agreed with you. We will not retrospectively remove an existing contractual right by updating the website.

If any provision is unenforceable, the remaining provisions continue to apply so far as legally possible. A delay in enforcing a right does not waive it. These terms and the accepted order details form the agreement for the relevant lead; they do not exclude liability for statements or representations where exclusion would be unlawful.

For business contracts, these terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. Any mandatory consumer protections and rights to bring proceedings in another competent court remain unaffected.
